Terms and Conditions

First4Movies act as an agent on behalf of third party organisers of film screenings and other events. We are not responsible for the running of or cancellation of any Event. Your use of the Site is subject to terms agreed with us, but any agreement giving you rights to attend an Event identified on a Ticket is made between you and the Supplier. The following terms apply as and when applicable to both your use of the Site and any benefit or offer provided by a Supplier.

By using or visiting the Site or by completing Registration, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws. First4Movies (F4M) reserve the right to change these Terms at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. If you violate these Terms of Use, F4M may terminate your use of the Site, bar you from future use of the Site, and/or take appropriate legal action against you.

Use of Site

You agree that you are only authorised to visit, view and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review information, for personal use, or to apply for screening tickets or comment on the Site, unless otherwise specifically authorised by F4M to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorised by F4M to do so. The content and software on this Site is the property of F4M and its subsequent partners and is protected by English law.

You also agree not to post Screening Codes "Codes" to any part of the Site or any other site. Codes are meant for personal use only and should not be distributed, unless specifically authorised to do so by F4M.

Registration

In order to access parts of the Site and to obtain Tickets, we require you to provide and register certain information with us. You must ensure that the information submitted in your Registration is complete and accurate. No Registration shall be validly submitted other than via the standard registration screen on the. Conditions purported to be stipulated by you in any way to us, to the extent that they are inconsistent with the Terms, shall be void.

Where the Site or parts of the Site requires or intends Registration you agree to access those parts of the Site by use of the Login only. You agree to not create any link to any part of the Site except the homepage or where links are specifically permitted and shall not violate or bypass any measures employed or designed to restrict access to any part of the Site.

You agree to keep the Login confidential at all times, shall take reasonable steps to prevent others from obtaining your Login and shall inform us if at any point you consider that your Login has been compromised and/or is being misused by someone else and shall take such action as is required and/or is requested by us to prevent such misuse.

By completing Registration you are confirming that you are over the age of 18 or otherwise have the consent of your parent or guardian to register with the Site and purchase Tickets.

Disclaimers

F4M does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from use of the Site. The Site and its Content are delivered on an "as-is" and "as-available" basis. F4M cannot ensure that any files you download from the Site will be free of viruses or contamination or destructive features. F4M makes no guarantee of any specific result from use of this Site or use of the F4M service.

F4M disclaims any and all liability for the acts, omissions and conduct of any third party users, advertisers or sponsors on the Site, in connection with the F4M service or otherwise related to your use of the Site and/or the F4M service. F4M is not responsible for the services or failure to act of any cinema. Without limiting the foregoing, you may report the misconduct of users and/or third party advertisers, service and/or product providers referenced on or included in the Site to F4M at help@first4movies.com.

Events and Tickets

You acknowledge and accept that F4M act as agent on behalf of the Supplier in the offering and issuing of Tickets, and that any rights that you may have by virtue of being issued a Ticket regarding the operation or non-running of an Event shall not be enforceable against F4M. You acknowledge and accept that the Supplier is specifically entitled to rely upon and enforce these Terms in relation to any relationship or obligations that may exist between you and the Supplier.

Display or reference to an Event on the Site shall not constitute an offer by either F4M or the Supplier capable of acceptance but shall instead be an invitation to you to make an apply for a Ticket to the Event. Tickets for Events are issued to applicants according to a procedure to be selected at F4M’s discretion which may include but is not limited to a first-come, first served policy, a random draw or a competition.

You acknowledge and accept that F4M or the Supplier may issue more Tickets than there are places available at an Event and that a Ticket shall not therefore guarantee a right to attend an Event. You agree to comply with all Additional Supplier Terms where these are made available or known to you.

Trademarks

F4M logos and design found on this site are protected . F4M logos and designs may be used publicly only with the written permission of F4M. Other logos or trademarks displayed on the site, remain the property of their owners and no licence to use any such logos or trademarks is at any time granted to you.

Ownership of Materials

All materials on the F4M website are copyrighted and are protected under treaty provisions and world-wide copyright laws. All film artwork remains the property of the respective distributors. All materials may not be reproduced, copied, edited, published, transmitted or uploaded in any way without written permission. Except as expressly stated in the limited licence provision of these terms and conditions, F4M does not grant any express or implied right to you under any of its trademarks, copyrights or other proprietary information.

Links and Search Results

The Site may automatically produce search results that reference or link to third party sites throughout the World Wide Web. F4M has no control over these sites or the content within them. F4M cannot guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive. F4M does not endorse the content of any third party site, except Screenrush.co.uk, nor do we warrant that they will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against F4M for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site.

User Content

Comments or forum posts by users are their own beliefs and are not necessarily the views of F4M. F4M reserve the right to remove posts deemed to be inappropriate and/or offensive.

The following is a partial list of the kind of Content which is illegal or prohibited on the Site. You agree not to upload, post or otherwise make available on the Site any content which falls under the following list. Prohibited Content includes Content that:

· Is protected by copyright, trademark or other proprietary right where you do not have the express permission of the owner of the copyright, trademark or other proprietary right;

· You are bound by confidentiality in relation to;

· is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; could be harmful to minors;harasses or advocates harassment of another person;

· involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";

· promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

· promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated movies or links to pirated movie files;

· contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);

· contains F4M Codes;

· displays pornographic or sexually explicit material of any kind;

· solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and;

· engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

You agree to not register or use more than one username. Any user found using more than one username without prior written (emailed) permission will be banned and all relevant posts and accounts will be removed at our discretion.

You grant to us a world-wide, royalty-free, irrevocable, non exclusive licence (including the right to sub-license) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any User Content (in whole or part) and/or to incorporate such content in other works in any form, media or technology now known or developed.

Offline Conduct

Although F4M cannot monitor the conduct of its Users off the Site, it is also a violation of these rules to use any information obtained from this Site in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit or sell to any User without their prior explicit consent.

No Commercial Use

No area of this Site may be used by our visitors for any commercial purposes such as to conduct sales of screening tickets or services of any kind. You must obtain our prior written consent to make commercial offers of any kind, whether by advertising, solicitations, links, or any other form of communication. We reserve the right to block access to this Site or F4M's other services, or to cancel a ticket request or ticket with respect to any person who is known or reasonably believed to be acting unlawfully, or breaching these Terms, or infringing F4M's rights, or utilising automated means to process or place ticket requests, or whose ticket requests exceeds the stated limit. Exceeding any limitations or breaching any terms on the Site will be deemed to be a breach of these Terms.

Access and Interference

You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained thereon or for any other unauthorised purpose without our prior express written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the F4M website. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content (except for your own personal, non-commercial use) from our website without the prior express written permission of F4M.

Unauthorised Use of the Site

Illegal and/or unauthorised uses of the Site, including, but not limited to, unauthorised ticket sales, unauthorised framing of or linking to the Site, or unauthorised use of any robot, spider or other automated device on the site, will be investigated and appropriate legal action will be taken, including without limitation civil, criminal and injunctive redress.

Violation of the Terms

You understand and agree that in F4M's sole discretion, and without prior notice, F4M may terminate your access to the Site, cancel your ticket request or exercise any other remedy available and remove any unauthorised User Content, if F4M believes that the User Content you provided has violated or is inconsistent with these Terms of Use violated the rights of F4M, another User or the law. F4M may release user information about you if required by law, or if the information is necessary or appropriate to release to address an unlawful or harmful activity.

Limitation on Liability

Except in jurisdictions where such provisions are restricted, in no event will F4M be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits, even if F4M has been advised of the possibility of such damages.

Disputes

This site is controlled and operated by F4M from its offices in the United Kingdom. If there is any dispute about or involving the Site, by using the Site, you agree that the dispute will be governed and construed by English law. In the event of a dispute arising out of or relating to these terms and conditions, or your use of or access to this site, litigation must be brought in court in London, England without regard to its conflict of law provisions.

Indemnity

You agree to indemnify and hold F4M, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable legal fees, made by any third party due to or arising out of any breach of these terms or your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site.

Definitions

In these Terms, the following definitions have the following meenings:

“Additional Supplier Terms”: any additional terms and conditions applying to Events communicated by us on the Site or by a Supplier on the Ticket or at an Event.

“Event” the film screening or other event identified on the Ticket.

“Login”: the personal username and password which may be created by you upon Registration, (which may be amended from time to time as enabled via the Site) allowing you to access and use the Site;

“Registration”: the process of registration in compliance with these terms and the procedure set out on the Site;

“Site”: the First4Movies web site at www.first4movies.com and any of the sub-domains thereof;

“Supplier”: any organiser of the Event.

“Terms”: these Website and General Terms;

“Ticket”: the Ticket for the Event sent or made available to you by us.

“you”, “your”, “yourself”: the individual, using or Registering with the Site (Registrant) or if the individual Is acting for or on behalf of others as an agent, including for avoidance of doubt where one individual registers and books on behalf of a group, both the individual and said others jointly and severally.

“User Content”: all text, images, footage, related data or other material inputted, uploaded or otherwise communicated by you to the Site or to us including by way of selecting items to be linked to the Site
